The Vidyasagar Institute of Mental Health, Neuro and Allied Sciences (VIMHANS), Delhi was ordered to pay Rs. 15 lakhs compensation to the family of a minor whose cancer, the institute failed to detect, leading to his death.
The States Consumer Dispute Redressal Commission directed the institute to pay the compensation after a plea was made by the boy's father. The family had claimed that doctors had failed to detect malignancy despite performing brain surgery, marking it as a case of medical negligence. And though the doctors had deemed the surgery as successful, the boy lost his vision and speech and slipped into coma for 5 months.
Doctors detected third-stage cancer only upon reopening the brain and advised the patient radiology options, without discussing the illness with his parents. The hospital however, has stated that all reports and details were shared with the parents and that the patient was brought to the hospital in a critical state.
