A medical practitioner, who could not carry on his professional life for six months due to an accident, was awarded Rs. 12.29 lakh by the Motor Accident Claims Tribunal (MACT), against the medical expenses incurred on his treatment.
In its recent order, the MACT directed the opposing parties-Harvinder Singh and the New India Assurance Company-to jointly make the payment of compensation amount, levied with eight per cent interest, to victim Gulrez Mansuri. The 37-year-old doctor stated in the Tribunal that on November 12, 2009, a trailer owned by Harvinder Singh dashed his two-wheeler on Panvel-Sion road.
The accident rendered Dr Mansuri bed-ridden for six months, which resulted in financial loss of Rs. 4 lakhs, as he could not carry on his professional life, the victim contended. However, the Counsel representing the insurance company argued that the doctor was driving in a rash manner without following traffic rules, which led to the road mishap. Listening to the arguments from both the parties, the MACT remarked that from the hospital discharge bills submitted by the claimant, it is proved that he sustained grievous injuries in the accident and hence, is liable for the compensation.
